An Analysis of Level of The Reflection of the Critical Criminology Thinking in Sphere of Iran’s 2013 Code of Islamic Criminal Law

Abstract

The critical and conflicting theories of criminology (critical system) with their various and different viewpoints and forms, have confronted the traditional and conventional criminology theories (traditional system). The criticalsystem has challenged the traditional system for its deficiencies in fighting against criminal phenomena, solving a great number of court cases, increased criminals and prison population, also for deficiencies in solving inequality and discriminative structure in society, as set in such models as racism, sexual discrimination and class inequality.
The criticalsystem, instead, pays due attention to improve criminal justice system status through important strategies, to amend existing unequal structures in society, to control and fight against main causes of crimes, not only in guilty person and his environment, but also in the discriminative and class inequality of the society. As a result of those challenges, some achievements have been gained in the domain of the traditional criminology, including in Iran, through limiting the state control in some areas of criminal justice system, which result in the adoption of certain adaptable theories that support decriminalization view. In this paper we aim to analyze and reflect some teachings and achievements in the criminology and criminal policy of Iran through legislative substantive rules.
